Veterans Disability Claims

Disability Benefits for Veterans are Routinely Denied.

Veterans of the U.S. military who have been injured during their time in the service can receive disability benefits. Like anything that involves the government, it takes a little more work to prove your case, but the benefits are there for those with serious injuries. You can even get a pension if you’re disabled, your income is limited and you’re over 65 years old. If you’ve already filed for one injury, you can file a new claim for a separate disability provided it is not related to the one for which you have already sought compensation.

To qualify for veteran disability compensation, you must meet the following conditions.

  • You currently have a medically diagnosed disability.
  • The injury or disease must have occurred while you were serving in the military.
  • Your present medical condition must be related to the same injury that you received while in the service.

If you need to file for disability, you should find a lawyer with experience in Veterans Disability Compensation law to handle your case. There are several ways to file, so it’s best to have a lawyer who has been through the process previously. The government admits that up to 70 percent of the disability claims submitted to the VA are improperly denied. Extra funding has already been approved to alleviate the logjam of unjustly denied benefit claims.

There are a few types of disability that are prevalent among veterans. The most common is panic disorder, which is manifested from Post-Traumatic Stress Disorder (PTSD). The symptoms of this disorder include the following.

  • Panic attacks.
  • Depression.
  • Psychosis.
  • Suicidal or homicidal tendencies.
  • Bipolar disorder.

Gulf War Syndrome is another condition suffered by many vets. It is characterized by sleep disorders, gastrointestinal problems, rashes plus joint and muscle pain. Although the cause is unknown, it’s possible that exposure to oil well fires, chemical drops and pesticides could be to blame. Pyridostigmine bromide pills might also be responsible for the symptoms. Soldiers used these pills to protect themselves from nerve gas.

There has also been a connection established between service in the military and Lou Gehrig’s disease, which is also known as Amyotrophic Lateral Sclerosis (ALS). The progressive disease attacks the nervous system and usually results in death.

Your Sunrise, FL Veterans Disability Lawyers

If you believe that you have a veteran disability, you need to find a lawyer who isn’t afraid to challenge the Veterans Administration. Case backlogs are common, and benefits can be slow in arriving. Additionally, the VA has denied claims because they feel that some anxiety disorders were in place prior to the victims’ periods of service.
